1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of qreativethemes.com and the WordPress themes, related products, and optional professional services (“Products and Services”) provided by QreativeThemes (“we,” “us,” or “our”).

By accessing our website or purchasing our Products, you agree to be bound by these Terms.

2. Products and Licensing

All Products are sold under a license agreement and are not sold outright.

Purchases via ThemeForest

If you purchase through ThemeForest, your license is governed by Envato’s Standard License terms in addition to these Terms.

ThemeForest/Envato handles transaction processing and license issuance.

Purchases via Freemius

If you purchase directly through Freemius, your license terms are presented at checkout and apply in addition to these Terms.

Freemius manages billing, subscriptions (if applicable), and license activation.

In the event of any conflict between these Terms and the applicable marketplace or platform license terms, the marketplace or platform terms shall prevail.

The purchase of a Product does not include installation, customization, optimization, or other professional services unless explicitly stated. Such services are optional and must be purchased separately.

3. Intellectual Property

The Products include original materials developed by QreativeThemes as well as third-party components licensed under their respective licenses. Your purchase grants a license to use the Product. No ownership rights are transferred.

4. Payments and Refunds

ThemeForest Purchases

Refunds are subject to Envato’s refund policy and must be requested through their platform.

Freemius Purchases

Refund requests must comply with the refund terms displayed at checkout or within Freemius’ system.

We reserve the right to deny refunds where:

  • The Product has been downloaded and used extensively.
  • The issue arises from third-party software.
  • The request falls outside the stated refund window.

5. Support

Support is provided exclusively to customers with an active support subscription and a valid license.

Support includes:

  • Assistance with theme features
  • Bug fixes
  • Basic configuration guidance

Support does not include:

  • Custom development
  • Third-party plugin conflicts
  • Server & domain configuration
  • Customization beyond default options
  • SEO and performance optimization

Support is available for the duration specified by your license. All support requests must be submitted through our official support desk. We do not provide support via social media, phone calls, email, or any other communication channels outside of our support desk.

We reserve the right to refuse support in cases of abuse or unreasonable demands.

6. Updates

ThemeForest Purchases

If you purchased a Product through ThemeForest, updates are made available through your ThemeForest account.

You may download the latest version of the Product from the Downloads page of the ThemeForest account used to purchase the theme.

Access to updates is subject to Envato’s licensing terms. We do not control the availability, delivery systems, or policies of the ThemeForest platform.

Freemius Purchases

If you purchased a Product through Freemius, updates are available to customers with an active license.

To receive automatic updates, you must enter and maintain a valid License Key within the WordPress admin area of your website. Updates may also be installed manually via FTP or other standard WordPress update methods.

Failure to maintain an active license may result in loss of access to automatic updates.

We reserve the right to modify, limit, or discontinue updates for any Product at our discretion.

7. Pricing

We reserve the right to modify the price of any product at any time, at our sole discretion. Any price changes will not affect licenses that have already been purchased prior to the effective date of the change.

Subscription renewals will continue at the original purchase price unless otherwise stated in a prior renewal notification. We reserve the right to provide notice of any changes to renewal pricing in advance of the applicable billing date.

8. Services

We may offer optional professional services, including but not limited to theme installation, page speed optimization, customization, and design services.

These services are not included with the purchase of any Product and must be purchased separately.

The services provided will be limited to the scope described in the written proposal, invoice, or agreement accepted by the client. Any work outside the agreed scope may require a separate quote and written approval.

Unless otherwise stated in writing, customization and design services include up to two (2) rounds of revisions. Additional revisions may be billed separately.

Fixed-price services must be paid in full prior to commencement unless otherwise agreed.

For custom projects exceeding €500, we may require a deposit prior to commencement, with the remaining balance due upon completion before final delivery.

Payments for services are non-refundable once work has commenced, unless otherwise required by applicable law.

Any timelines provided are estimates only and are not guaranteed.

Upon full payment, the client is granted a non-exclusive license to use the completed work for its intended purpose.

The client retains ownership of materials they provide.

QreativeThemes retains ownership of pre-existing materials, proprietary tools, and reusable components used in the project. Third-party themes, plugins, and other components remain subject to their respective licenses.

The client is responsible for providing necessary access credentials, materials, and approvals. We are not responsible for delays caused by failure to provide required information.

We reserve the right to refuse or terminate service engagements at our discretion.

9. User Responsibilities

You agree to:

  • Provide accurate purchase information.
  • Maintain the confidentiality of your license key.
  • Use the Product in compliance with applicable laws.
  • Not attempt to reverse engineer, exploit, or abuse the Product.

You are responsible for maintaining backups of your website and data.

10. Third-Party Services

Our Products may integrate with or rely on third-party services, plugins, or platforms.

We are not responsible for:

  • Third-party software performance
  • Platform policy changes
  • Hosting provider issues
  • External service outages

Use of third-party services is at your own risk and subject to their respective terms.

11. Termination

We reserve the right to:

  • Suspend or terminate licenses
  • Refuse service
  • Refuse refund (see section 4)
  • Disable license keys

if you violate these Terms.

Upon termination, you must cease using the Product. Termination does not entitle you to a refund unless required by applicable law.

12. Disclaimer of Warranties

The Products are provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not warrant that the Products will be uninterrupted, error-free, secure, or compatible with all third-party software, plugins, hosting environments, or future versions of WordPress.

To the maximum extent permitted under applicable law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.

13. Limitation of Liability

To the maximum extent permitted by law, QreativeThemes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from the use or inability to use the Products.

Our total liability shall not exceed the amount paid for the Product.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of The Netherlands, without regard to conflict of law principles.

If you are a consumer residing in the European Union, mandatory consumer protection laws of your country of residence may apply in addition to the laws of The Netherlands.

15. Modifications to These Terms

We may update these Terms at any time. Changes become effective upon posting on our website. Continued use of our Products constitutes acceptance of updated Terms.
